Welcome to www.mdtopicals.com and any related websites that link to these Terms (collectively, the “Website”), owned and operated by MD Topicals LLC (“MD Topicals,” “we,” “us,” or “our”). Except as otherwise noted, these Terms of Service (the “Terms”) govern your use of the Website and MD Topicals’ services, applications, and content (collectively, the “Site”), as well as your purchase, receipt, or use of products made available through the Site (collectively, the “Product(s)”).
PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SITE OR PURCHASING, RECEIVING, OR USING OUR PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE OR PURCHASE, RECEIVE, OR USE OUR PRODUCTS.
THESE TERMS CONTAIN A MANDATORY INDIVIDUAL ARBITRATION PROVISION AND CLASS ACTION/JURY TRIAL WAIVER REQUIRING ARBITRATION ON AN INDIVIDUAL BASIS.
We may change these Terms at any time in our sole discretion. If we make material changes, we’ll provide notice (for example, by email or on the Site). By continuing to use the Site after notice, you accept the revised Terms. If you do not agree, you must stop using the Site and not order Products.

1) Account Creation; Eligibility
You may use the Site only if you can form a binding contract with MD Topicals and only in compliance with these Terms and all applicable U.S. federal, state, and local laws and regulations. To purchase from the Site, you may need to create an account by providing accurate, complete information (for example, name and email) and keeping it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Do not share your credentials. Notify MD Topicals immediately of unauthorized use. By registering, you consent to transact with us electronically and to receive communications consistent with our Privacy Policy (incorporated by reference). You are responsible for your device connectivity and data plans.

2) Terms of Sale
Orders, Pricing, and Payments. We strive for accurate pricing and product information but are not responsible for typographical or other errors. Displayed colors may vary by monitor. Products may be out of stock or discontinued, and prices are subject to change. We may accept, reject, or cancel orders in our sole discretion and will attempt to notify you using the email and/or billing details you provide. Unless otherwise agreed by us, payment must be received before order acceptance. We may process payment for and ship parts of an order separately.
Quantity Limitations and Restrictions. We may limit or cancel quantities per person, household, or order (including orders using the same account, card, billing, and/or shipping address) and may restrict or terminate accounts in our sole discretion.
Resellers Prohibited. Purchases are for personal use only. You may not resell or export Products.
Shipping. We currently ship only within the United States. You agree to pay the shipping and handling charges shown at checkout. Shipping terms, carriers, timing, and fees may change; see our FAQ page for current details.
Taxes. We collect applicable sales tax where required. Amounts shown at checkout may adjust (for example, rate changes). If you have a valid exemption certificate applicable to your purchase and ship-to location, provide it prior to purchase.

Product Disclaimer. Use Products strictly per their instructions, precautions, and guidelines. Always review ingredient lists for potential sensitivities. The Site is an online store for specialty beauty products and is not a substitute for professional medical advice. Consult your own physician or healthcare provider about any questions regarding the use of any Products or information from the Site. We do not offer prescription medications or medical treatments. IF YOU REQUIRE MEDICAL ATTENTION, CALL 911 OR CONTACT A MEDICAL PROFESSIONAL IMMEDIATELY. We may cancel or limit orders to prevent misuse or violations of these Terms.

3) Security Rules
Violations of system or network security may result in civil or criminal liability. We may investigate and cooperate with law enforcement. You may not: (i) access data not intended for you or log onto a server/account you are not authorized to access; (ii) probe/scan/test system vulnerabilities or breach security/authentication; (iii) interfere with Site operation (e.g., viruses, overloading, flooding, mail-bombing, crashing); or (iv) forge headers or otherwise manipulate identifiers.

4) Prohibited Uses; Access
The Site is for lawful, personal, non-commercial use: viewing the Site, purchasing Products, providing information, and downloading product information for personal review. You are responsible for your communications and their consequences. You agree not to: (i) post information that is incomplete, false, inaccurate, or not your own; (ii) engage in activity that violates law or accepted Internet protocol; (iii) post materials without necessary permissions (copyright, trade secret, privacy, publicity, or other rights); (iv) transfer software or information in violation of export control laws; or (v) interfere with the Site, our networks, or network security.
No materials from the Site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed except as explicitly permitted. We grant you a personal, limited, nonexclusive, nontransferable license to access the Site and use its information and services for personal, non-commercial use. We may change or discontinue any part of the Site at any time without liability. We may impose rules/limits or restrict access at our discretion.

5) Proprietary Rights
As between you and MD Topicals, MD Topicals owns (or is an authorized user of) all trademarks, trade names, service marks, trade dress, copyrights, and other intellectual property on the Site (collectively, “Intellectual Property”). You may not display or use our Intellectual Property without prior written consent. Use of the Site does not grant you any license to our content except as expressly permitted. Any commercial use is prohibited without our approval. Unauthorized use may violate laws and result in liability.

“User Content” means any content you submit or post on the Site or our social accounts or via tools we provide (including content you post on your social media accounts and tag with our handles or promoted hashtags, e.g., #MDTopicals), such as photos, videos, audio, text, comments, feedback, ideas, or data.
By submitting or posting User Content, you grant MD Topicals a perpetual, irrevocable, royalty-free, transferable, sublicensable, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit such content in any media, for commercial or noncommercial purposes, without compensation to you. You represent and warrant that you own or control the rights in your User Content and that its posting does not violate the rights of others.
You remain the owner of your User Content, subject to this license.

If you believe your work has been copied in a way that constitutes copyright infringement, please provide MD Topicals’ designated agent with the following (per the DMCA):

(iv) your contact information;
(v) a statement of good-faith belief that the use is unauthorized;

11) Disclaimers and Limitations of Liability

To the fullest extent permitted by law, MD Topicals is not liable for any indirect, incidental, consequential, special, or punitive damages, or loss of profits, data, or business, even if advised of the possibility. Our maximum aggregate liability for any claim relating to Products is limited to the amount paid for the Products. Our maximum aggregate liability relating to the Site is limited to $100 or the amount you paid to us in the one month before the claim arose.

Any dispute arising out of or relating to these Terms, the Site, or Products shall be resolved by binding arbitration in Florida, administered by the American Arbitration Association (AAA) under its rules. Arbitration will be on an individual basis; no class or representative actions are permitted. If arbitration is unavailable, disputes will be resolved exclusively in the state or federal courts located in Florida. You waive any right to a jury trial.

These Terms constitute the entire agreement between you and MD Topicals. If any provision is found invalid, the remainder shall continue in effect. We may assign our rights without restriction. Section titles are for convenience only.
